Acceptance of Terms
By creating an account or using Clearly Me, you agree to these Terms of Use (“Terms”). These Terms form a legally binding agreement between you and Clearly Me. If you do not agree, you should not create an account or use the Service.
Account Cancellation & Credits
Free Trial: New Users receive a 7-day free trial with unlimited questions. No charges will be made during this period.
Credits and Billing: After the trial, your account will be billed for your first credit bundle ($24.50, which includes the assessment and approximately 400 questions). Additional bundles of credits are billed at $5.95 for approximately 400 questions each. Credits are automatically refilled when your balance is low.
Cancelling Your Account: To stop future charges, you must cancel your account by contacting Clearly Me support. Cancelling ends future billing and stops access to new questions once your credits are used. You will still be able to view your past results.
Refunds: Purchased credits are non-refundable and non-transferable.
Payment Terms
Currency: All fees are payable in U.S. dollars (USD).
Secure Processing: Payments are processed through a PCI DSS-compliant third-party provider.
Credits: Credits are prepaid units used to ask questions in the Clearly Me platform. One credit is deducted for each question. Credits remain valid as long as your account is active.
Failed Payments: If a payment is declined, Clearly Me may attempt to process it again. If payment cannot be completed, your ability to ask new questions may be suspended until the issue is resolved.
Account Owner Responsibility: The Account Owner is responsible for maintaining valid payment information and ensuring that billing is kept current.
Client & Participant Responsibilities
Consent and Use of Information
By completing an assessment, Users consent to Clearly Me storing their results and generating insights based on them. Users also agree to receive service updates and relevant communications. Participation implies agreement to the Clearly Me Privacy Policy.
Restrictions
Clients and Users may not reproduce, distribute, or disclose assessments or content outside of the Service. All assessments, reports, and related materials are proprietary to Clearly Me and must remain confidential.
Acceptable Use Policy
You agree not to:
- Post or share content that is illegal, harmful, abusive, defamatory, or invasive of privacy.
- Engage in activities that exploit or harm minors.
- Impersonate others or misrepresent your affiliation.
- Disrupt or interfere with the Service, its servers, or connected networks.
- Violate any applicable laws or regulations.
Consequences: Violations may result in suspension or termination of your account, legal action, or financial liability for corrective costs.
Reporting: Report violations to support@clearly.me with “AUP Violations” in the subject line.
Intellectual Property
All intellectual property associated with Clearly Me — including assessments, reports, software, databases, logos, trademarks, and content — remains the exclusive property of Clearly Me.
You are granted a limited, non-transferable license to use the Service for personal or organizational purposes. This license ends if your account is cancelled or inactive.
Unauthorized use, reproduction, or distribution of Clearly Me materials is prohibited and may result in civil or criminal penalties.
Marketing & Feedback
By submitting feedback, reviews, or testimonials, you grant Clearly Me a worldwide, royalty-free license to use, reproduce, and display that content for promotional purposes.
Indemnification
By Users and Clients: You agree to indemnify and hold Clearly Me, its employees, officers, and agents harmless from claims, damages, or expenses resulting from your violation of these Terms or misuse of the Service.
By Clearly Me: Clearly Me agrees to indemnify Clients and Users against claims that the Service infringes a third party’s intellectual property rights.
Limitation of Liability
Clearly Me is not liable for indirect, incidental, or consequential damages — including loss of data, profits, or goodwill — arising from:
- Use of or inability to use the Service.
- Unauthorized access to or alteration of your content.
- Conduct or content of third parties.
These limitations apply even if Clearly Me has been advised of potential damages.
Legal Compliance
You agree to use Clearly Me in compliance with all applicable laws, including those governing privacy, data protection, and intellectual property.
The Service is provided “as is” without warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose.
Term & Termination
This Agreement remains in effect until cancelled by you or terminated by Clearly Me. Clearly Me may suspend or terminate access immediately if you breach these Terms. Upon termination, your right to use the Service ceases.
Entire Agreement & Governing Law
These Terms represent the entire agreement between you and Clearly Me. They are governed by the laws of the State of Texas, with jurisdiction in the courts of Tarrant County, Texas.
If any provision is found invalid, the remainder will remain in effect. Failure to enforce any provision does not waive the right to enforce it later.
Definitions
- Service: The Clearly Me platform, including assessments, personalized insights, and Q&A features.
- Client: Any business, school, ministry, or organization that contracts with Clearly Me.
- User: Any individual using the Service.
- Account Owner: The individual who creates a Clearly Me account. For organizational accounts, the Account Owner is also responsible for managing billing, payments, and account activity on behalf of all associated Users.
- Credits: Prepaid units that allow Users to ask questions. One credit is deducted per question.
- Free Trial: A complimentary 7-day period with unlimited questions.
- Account Cancellation: Request to stop future charges and end access to new questions.
